An explosion at the Gerdau-Açominas steel plant, which occurred in 2002, is loudly echoing in the courts this week, in Belo Horizonte. This Thursday (1/12), an important chapter of the biggest legal dispute in the history of insurance in Brazil takes place. The litigation involves a claim for compensation of US$165 million — or R$365 million — which the steel company believes it has in credit in addition to what it has already received. This week's litigation is the exception of suspicion filed against first instance judge Nicolau Masselli. The fact that Gerdau-Açominas benefited during the investigation of the process is questioned. The decision is made by the 14th Panel of the Court of Justice, and its rapporteur is judge Dídimo Inocêncio de Paula, accompanied by Elias Camilo and Heloísa Combat.
The judge brought together the experts, lawyers and the Gerdau-Açominas reviewer with the Justice experts, without the presence of representatives from the insurance company SulAmérica and others. Thus, the expert criteria would have been combined without the knowledge of the opposing party. Thus, from the end of the 20th century, international organizations, States, workers' movements, companies Belize Email List and the Law have increasingly dedicated themselves not only to the adoption of measures and studies aimed at protecting physical integrity of the worker, but also their mental, psychological and emotional health and integrity. Along these lines, it becomes extremely important to understand the meaning of moral harassment , since this harassment, called mobbing , affects the worker's mental health.
The topic of mobbing , although it represents a phenomenon that has existed for a long time in the workplace, is relatively new, including for European nations, which began to carry out studies on mobbing in the 1980s, especially since the research by professor dr. Heinz Leymann , German psychologist and medical scientist, who began his work on moral harassment based on the relationship he found between the large number of patients undergoing treatment for psychological problems and their difficulties in personal relationships at work. Thus, the ILO, using its powers to develop international standards relating to Labor Law issues, published, in 2002, a Report on some forms of bullying, listing various behaviors that proved to be more typical or common.
